Terms of Service — PlexiPaws

1) Who we are

These Terms govern your use of the PlexiPaws website, products, and services

2) Acceptance of terms

By accessing our site or purchasing from us, you agree to these Terms and our Privacy Policy, Shipping Policy, and Returns & Refunds Policy (together, the Policies). If you do not agree, do not use the Services.

3) Eligibility

You must be 18+ (or have parent/guardian consent) and able to enter a binding agreement. Provide accurate details and keep your login secure.

4) Products, info & availability

• We aim for accuracy; errors (pricing/specs/availability) may occur. We may correct and update without notice.

• Colours/finishes can vary by screen.

• We may limit quantities or discontinue items.

5) Orders & acceptance

• Your order is an offer to buy. We accept when we dispatch the item(s); a contract forms then.

• We may decline/cancel (e.g., suspected fraud, mispricing, stock issues). Any payment taken for a cancelled order will be refunded.

6) Pricing, taxes & payment

• Prices are in AUD and include GST (where applicable).

• You’re responsible for charges from your bank (e.g., currency conversion/FX fees).

• We accept payment methods shown at checkout; you confirm you’re authorised to use them.

• If a pricing error is obvious and could reasonably be recognised as such, we may cancel and refund.

7) Shipping & delivery (AU & international)

• Processing and delivery estimates are in our Shipping Policy.

• Free shipping offer: As described in the Shipping Policy (e.g., Free Standard Shipping on AU orders A$120+ after discounts). International orders are not included unless stated.

• Risk in goods passes on delivery to the address provided (or collection, if offered). Title passes after full payment.

• International customers: You are responsible for import duties, taxes, and customs fees. Customs inspections may cause delays. We cannot mark orders as gifts or lower declared values. Some destinations may be unavailable or restricted—see Shipping Policy.

8) Returns & 30-day trial

• Our Returns & Refunds Policy explains returns, including our 30-day “Buy & Try”: use it at home; if it’s not a fit, return clean, undamaged, and with all parts/packaging for a fast refund.

• International returns: unless required by local law, original shipping, duties, and customs fees are non-refundable; return shipping is at your cost.

• Certain items may be ineligible for return for hygiene or damage reasons—see the policy.

9) Consumer rights (AU & international)

Nothing in these Terms excludes or limits non-excludable rights under Australian Consumer Law (ACL) or other mandatory consumer protection laws that apply in your country of residence. Where we cannot exclude liability, our liability is limited to the minimum extent permitted by applicable law.

10) Use & care

Follow our Care & Use guidance. Misuse, neglect, unauthorised repairs, or commercial use may void any voluntary warranty we provide (this does not affect rights under applicable consumer laws).

11) Intellectual property

All site content (text, graphics, photos, video, code, design) is owned by or licensed to PlexiPaws and protected by IP laws. Do not copy, modify, distribute, or use our IP without written consent.

12) User content (reviews/UGC)

If you submit reviews, photos, videos, or comments (User Content):

• You grant us a worldwide, royalty-free, non-exclusive, sublicensable licence to use, reproduce, modify, publish, and display your content for marketing, ads, and site use.

• You confirm you own the content or have rights to it and that it’s accurate, lawful, and not misleading or offensive.

• We may moderate, edit, or remove User Content.

13) Prohibited conduct

You must not:

• Break laws or infringe IP, privacy, or other rights.

• Upload malware/spam or deceptive, defamatory, hateful, or harmful content.

• Interfere with site security or operation.

• Scrape or data-mine except as allowed by law and our robots.txt.

14) Third-party services

We integrate third-party services (e.g., payments, couriers). Their terms and policies apply; we aren’t responsible for their content or security. Use them at your own risk.

15) International use & compliance

You are responsible for complying with local laws when accessing our site or purchasing from outside Australia, including import restrictions, sanctions, and product compliance in your country. We may restrict sales to certain countries or regions.

16) Limitation of liability

To the maximum extent permitted by law and subject to Section 9, we are not liable for indirect, incidental, special, or consequential loss, loss of profits, or loss of data arising from your use of the Services or purchase of products. Where liability cannot be excluded, it is limited to, at our option, re-supplying the Services or refunding the amount paid.

17) Indemnity

You agree to indemnify PlexiPaws, our officers, employees, and agents against claims arising from your breach of these Terms or misuse of the Services.

18) Promotions, gift cards & discount codes

Promotions and codes are subject to their stated terms, cannot be transferred or redeemed for cash, and may expire or be withdrawn. Gift cards are governed by terms at purchase and applicable laws (including expiry rules in your country, if mandatory).

19) Privacy & data transfers

We handle personal information per our Privacy Policy. By using the Services, you consent to the collection, use, and cross-border transfer of your data as described there, including storage in Australia or other countries. Where legally required, we implement appropriate safeguards.

20) Changes to Services & Terms

We may modify, suspend, or discontinue parts of the Services at any time. We may update these Terms by posting a new version with a new “Last updated” date. Continuing to use the Services after changes means you accept the updated Terms.

21) Governing law & venue

These Terms are governed by the laws of South Australia, Australia. You submit to the exclusive jurisdiction of the courts of South Australia and the Commonwealth courts of Australia with jurisdiction there, except that you may also have the benefit of mandatory consumer protections in your country of residence that cannot be limited by agreement.
